NDAA Compliance for Government Drone Buyers: What You Need to Know Before You Buy 

Choosing a drone for government use involves more than comparing flight time, payload capacity, camera specifications and cost. For U.S. government agencies, procurement decisions must also account for applicable security, cybersecurity and supply-chain requirements. 

That is where NDAA compliance becomes an important consideration. 

The term NDAA compliant drone is widely used across the drone industry, particularly in government and defence procurement, but understanding exactly what it means can be challenging. What does Section 848 of the National Defense Authorization Act (NDAA) require? What is the difference between Blue UAS and Green UAS? And how can government buyers determine whether a drone meets the requirements that apply to their organization? 

This guide breaks down the key considerations government drone buyers should understand when evaluating NDAA-compliant drones and selecting a platform for their operations. 

NDAA Compliance: What It Is and What You Need to Know 

The National Defense Authorization Act (NDAA) is annual U.S. legislation that establishes policies and authorities related to national defence and security. For organizations purchasing drones for government or defence applications, certain NDAA provisions have important implications for UAS procurement and supply-chain security. 

One of the most relevant is Section 848 of the FY2020 NDAA (10 U.S.C. § 4871 note), which restricts the U.S. Department of Defense from operating or procuring certain unmanned aircraft systems associated with covered foreign countries. 

Under Section 848, the covered countries are China, Russia, Iran and North Korea. 

Understanding NDAA compliance for drones, however, requires looking beyond where the finished aircraft is manufactured or assembled. Section 848 also addresses critical UAS components, software and supporting infrastructure 

For government drone buyers, this means evaluating more than the country of origin listed on the aircraft. A drone assembled in an approved country is not necessarily NDAA compliant if restricted components, software or data services are used elsewhere within the system. 

What Components are Covered Under NDAA Section 848?  

When evaluating an NDAA-compliant drone, government buyers need to look beyond where the aircraft itself is manufactured. Section 848 also applies to several critical components and systems that make up an unmanned aircraft system. 

A drone may be assembled in the United States or another approved country, but buyers should still understand the origin of key components, including flight controllers, radios, data-transmission devices, cameras and gimbals. 

The same scrutiny applies to the broader UAS ecosystem. Ground-control systems and operating software, as well as network connectivity and data storage, can also affect whether a platform meets applicable NDAA requirements. 

For government agencies, this makes supply-chain transparency an essential part of drone procurement. Buyers should understand not only who manufactures the aircraft, but also where its critical hardware and software originate, how the system communicates, and where operational data is stored or administered. 

Blue UAS vs. Green UAS 

When researching NDAA-compliant drones, these two terms frequently appear: Blue UAS and Green UAS. While both are intended to help organizations identify secure and trusted drone technologies, they serve slightly different purposes. 

Blue UAS originated as a U.S. Department of Defense initiative to evaluate commercial drones and components for defence use. The Blue List, now managed by the Defense Contract Management Agency (DCMA), identifies unmanned systems and components that have undergone the applicable assessment process and are approved for Department of Defense procurement and operation. 

Since Blue UAS status can change as platforms and manufacturers complete the review process, buyers should always verify a system against the official Blue List rather than relying solely on manufacturer marketing materials or older product documentation. 

Green UAS, meanwhile, is an industry-led certification program administered by the Association for Uncrewed Vehicle Systems International (AUVSI). It evaluates areas such as cybersecurity, supply-chain integrity and trusted components and was originally designed to provide additional assurance for commercial, government, public safety and critical-infrastructure users. 

In July 2025, the Defense Innovation Unit formally recognized the Green UAS certification process as an accepted pathway to achieving Blue UAS Cleared status. This alignment gives manufacturers another route through the assessment process while helping government buyers identify platforms that have undergone independent cybersecurity and supply-chain review. 

In practical terms, Blue UAS is closely tied to U.S. Department of Defense procurement, while Green UAS provides a broader cybersecurity and supply-chain assurance framework that can also lead to Blue UAS Cleared status. 

Neither designation, however, eliminates the need to review the specific procurement rules, security requirements and contract conditions that apply to the purchasing agency. 

How Can You Verify a Manufacturer’s NDAA Claim? 

When a manufacturer describes a drone as NDAA compliant, that is an important starting point – but government buyers should take additional steps before making a purchase. 

Start by confirming the exact model covered by the claim. A product family may include different aircraft, radios, controllers, payloads or software configurations, and those differences can affect compliance.  

Buyers should also request information about the origin of its critical components, operating software, communications systems and data storage infrastructure. 

If the manufacturer states that a particular system is Blue UAS Cleared, verify the exact model against the current official Blue UAS list. 

Federal buyers should also consider requirements introduced by the American Security Drone Act of 2023 (ASDA) and implemented through the Federal Acquisition Regulation (FAR) Subpart 40.2. Under these rules, a FASC-prohibited unmanned aircraft system is a UAS manufactured or assembled by an American Security Drone Act-covered foreign entity. The Federal Acquisition Security Council maintains the applicable covered-entity list, which is published through SAM.gov. 

Finally, buyers should review the agency’s solicitation and contract requirements. A manufacturer’s general NDAA claim does not automatically satisfy every requirement attached to a particular procurement. 

Does Section 848 Apply to Every Government Buyer? 

The answer depends on the buyer and the procurement. 

Section 848 specifically applies to the Department of Defense. However, other federal agencies are also subject to additional drone procurement restrictions. 

The American Security Drone Act of 2023 (ASDA) introduced additional restrictions that are now implemented through FAR Subpart 40.2. Executive agencies generally cannot acquire a FASC-prohibited UAS unless an applicable exemption, exception, or waiver applies. 

The rules also address certain UAS operating services and the use of federal funds for UAS procurement and operations. 

Therefore, if you are buying a drone for a federal agency, the relevant question is not only “Is this drone NDAA compliant?” but also “What procurement requirements apply to my agency?” 

 That distinction is important because NDAA compliance may be only one part of the overall procurement review. 

What About State and Local Government Agencies? 

Federal requirements are not the only consideration for government drone buyers. 

States and local jurisdictions may establish their own restrictions and requirements for government drone procurement and use. Depending on the state, these may address manufacturers, countries of concern, cybersecurity or the use of government funds. 

If you are purchasing a drone for a state, county, city, police department, fire department, or emergency management agency, review the applicable state and local requirements before making a purchase. 

A drone that meets one federal requirement may still need additional review under state or local rules. 

What Happens If You Buy a Non-Compliant Drone? 

For a government agency, selecting the wrong drone can become both a compliance and procurement problem. 

Under current federal acquisition rules, executive agencies generally cannot acquire a FASC-prohibited UAS unless an applicable exemption, exception or waiver applies. 

Depending on the circumstances, this can result in procurement delays, additional costs, contract complications or a system that cannot be used or funded as originally planned. It is much easier to identify these issues during vendor selection than after a contract has been signed. 

NDAA-Compliant Drones for Government Agencies 

Once the compliance requirements are understood, the next step is finding a system that meets the agency’s operational needs.
